Terms of use
Please read these terms before you use DRUM VR. They are written to be clear, not clever.
1. Agreement
These Terms of Use (the “Terms”) apply to your use of the DrumVR.com website and the DRUM VR web app (together, the “Service”), operated by DRUM VR (“we” or “us”). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
2. The Service
- The Service is free to use and does not require an account.
- It is an early version and may contain bugs. We may change, pause, or stop any part of it at any time.
- You need a compatible device, a web browser, and an internet connection. We do not promise that it works on every headset or browser. The headset guide lists what we have tested.
3. Play safely
Virtual reality involves moving around while you cannot see your surroundings. You use it at your own risk, so please:
- Clear your play area of people, pets, furniture, stairs, and other hazards, and keep cables out of the way. Set up your headset’s play boundary before you start.
- Take regular breaks.
- Stop right away if you feel dizzy, nauseous, uncomfortable, or unwell, or if your eyes, head, or hands hurt.
- Keep the volume at a comfortable level to protect your hearing.
- Play seated if you prefer. The Seated preset lowers the kit for that.
- Talk to a doctor before using VR if you have epilepsy or a history of seizures, or any condition that VR could affect.
- Follow your headset maker’s safety and age guidance. A parent or guardian should supervise younger players.
4. Acceptable use
You agree not to:
- break the law or violate anyone’s rights when using the Service;
- interfere with or overload the Service, or try to get around its security;
- use bots or automated tools in a way that harms the Service or other people’s use of it;
- copy the Service or its brand in a way that suggests it is yours or that we endorse you.
5. Our content and your license
The Service, including its design, text, graphics, code, sounds, and the names DRUM VR and DrumVR.com, belongs to us or our licensors and is protected by law. We give you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use.
Some parts of the Service use open-source software, including three.js (MIT license) and the Big Shoulders Display and Instrument Sans fonts (SIL Open Font License 1.1). Those components stay under their own licenses.
6. Your data on your device
Your settings, kit layouts, preset names, and recordings are saved in your browser on your device. We do not receive them. Deleting your browser data deletes them. See Cookies and storage for how to manage this.
7. Learning content
The guides on this site share general information about drumming. They are not professional instruction or a promise of any result.
8. Third-party links and services
The Service may link to other websites and relies on a hosting provider. We do not control third parties and are not responsible for their content or practices.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted, error-free, or free of harmful components, or that it will work with your device.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, or for any injury or property damage that happens while you use VR. To the extent the law allows us to limit it, our total liability for any claim connected to the Service will not exceed US$100.
Nothing in these Terms limits liability that cannot be limited by law. Some places do not allow certain limits, so parts of this section may not apply to you.
11. Ending your use
You can stop using the Service at any time. We may suspend or end access for anyone who breaks these Terms or misuses the Service.
12. Changes to these Terms
We may update these Terms. When we do, we will change the date at the top of this page. If you keep using the Service after a change, you accept the updated Terms.
13. General
If any part of these Terms is found to be unenforceable, the rest stays in effect. These Terms, together with the Privacy Policy, are the whole agreement between you and us about the Service.
